Apex Dyno Night

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK Apex Autosports — Apex Dyno Night In exchange for being allowed to participate in Apex Dyno Night at Apex Autosports, I agree to the following. I am signing for myself and for anyone who might claim on my behalf. 1. RISK. Chassis dynamometer testing runs an engine and drivetrain at high load and high speed. Parts can fail. Engines can be damaged or destroyed. Tires, belts, driveshafts and other components can come apart. Fire, fluid loss, smoke, noise, heat and moving machinery are all present. I understand these risks are real and that some of them can cause serious injury or death, and I accept them voluntarily. 2. MY VEHICLE. I represent that my vehicle is mechanically sound and safe to run under load. I accept full responsibility for any damage to my vehicle, its engine, its drivetrain, its tires or anything in or on it, however caused, including damage that happens while Apex Autosports personnel are operating or working on it. 3. RELEASE. I release Apex Autosports LLC, The Timely Group LLC, and their owners, employees, contractors and guests from all claims for property damage and for personal injury arising out of my participation, except for claims arising from their own gross negligence or willful misconduct, which this document does not attempt to release. 4. NO WARRANTY OF RESULTS. Dyno figures are a measurement under specific conditions. No figure is promised, guaranteed, or represented as comparable to another shop's equipment. 5. MEDIA. Photos and video may be taken at this event and used by Apex Autosports on social media and in advertising. Tell staff on the day if you would rather not appear. 6. RULES. I will follow all instructions from Apex Autosports staff, stay out of marked areas, and keep passengers and children away from the dyno room while a vehicle is running. 7. FEES. Entry is $125. A $50 deposit holds my spot and is applied to the entry fee. The balance is due on the day. I have read this document, I understand it is a release of legal rights, and I am signing it freely.
